As Detention Home wrote about in June this is in conflict with Federal PREA laws. Including bans on cross gender strip searches and facilities must "implement policies and procedures that enable inmates to shower, perform bodily functions and change clothing without nonmedical staff of the opposite gender viewing their, breasts, buttocks or genetalia..."
Alpha News is covering women who were incarcerated at Shakopee Prison protesting against similar policies. “Forcing incarcerated women, who typically are nonviolent offenders, to share intimate spaces with these violent, predatory men is an act of cruelty that amounts to state-sanctioned torture and any rape that occurs under these circumstances must be understood as state-sanctioned,” added Bruss, a volunteer with Women’s Declaration International USA. In this writers opinion Hennepin County is opening itself up to lawsuits under PREA. A Corrections Officers main duty is protecting inmates. Housing male and female inmates together leaves the door wide open for assaults on both the trans inmates and normal inmates who may be preyed upon.
Sadly the current policy leaves Detention Deputies open to being sued if they put a trans inmate in the population of the opposite sex AND if they don't. They're damned if they do and damned if they don't.
